Gain AI Ltd. (Company No. 517074183, “Gain”, “we”, “our”, “us”) develops AI-powered solutions designed to support procurement, supply chain, and merchandising operations by enabling organizations to automate processes, improve efficiency, and enhance decision making.
This privacy notice (“notice”) details our privacy practices for processing personal data that we collect from you as a database controller.
This notice applies when you:
- Visit and use our website (https://getgain.com), and any of our other online activities, including on social networks, in addition to the social network’s own privacy notices;
- You communicate with us, including through email and other messaging systems;
- You meet us face-to-face, including at on-site events, and provide us with your details (such as at a conference, or in our offices);
- You interact with us in any other way, in our capacity as the database controller of personal data relating to you.
In this notice, we refer to all these activities as our “services”.
This notice does not apply to personal data we process as database processors on behalf of our customers.
This notice includes all details we are required to provide regarding personal data we collect and process about you.
We value your privacy and recommend that you read this notice thoroughly. If you conclude that this notice does not align with your preferences, you may choose not to use our services or provide personal data to Gain.
You are not required by law to provide us with any personal data. Any processing of your personal data is therefore conducted subject to your consent. If you do not consent to our processing practices, you are not allowed to use our services.
Under this notice:
- “Privacy Protection Law” means the Privacy Protection Law, 5741-1981
- “personal data” means as defined under the Privacy Protection Law.
- “data of special sensitivity” means as defined under the Privacy Protection Law.
- “database” means as defined under the Privacy Protection Law.
- “database controller” as defined under the Privacy Protection Law, and “database owner” as used in all regulations under the Privacy Protection Law.
- “processor” means “holder” under the Privacy Protection Law.
- “process”, “processing” means as defined under the Privacy Protection Law, and including the equivalent term “use” as used in all regulations under the Privacy Protection Law.

Privacy Notice
1. Personal Data that We Collect and Use
We process the following categories of personal data in the course of our services and related activities:
- Personal data you provide us with. For example, when you book a live demo or when you reach out to us using email.
In these cases, you might provide us with details such as: full name, work email address, phone number, company name and job title.
If you provide us with personal data about someone else through our services, you must do so only with that person’s explicit consent, and you must share this notice with that person. You must inform them how we process personal data related to them according to this notice before you provide us with such personal data.
Please note that you are advised not to include data of special sensitivity in any communications you send to us.
- Personal Data Relating to Your Use of the Services. For example, past interactions and inquiries you have had with Gain.
- Personal Data Regarding Your Use of the Website and Services that is Collected Automatically. This information may include details about how you use the services, as well as information about your device, some of which may constitute personal data.
Like many other websites, we use monitoring and tracking technologies to record your online activities. These technologies may include cookies, trackers, web beacons, pixel tags and other tracking technologies.
Some of the personal data processed through these tracking technologies is deleted when you close your browser. Others are stored on your device even after you have finished using the services.
Further information about your options to manage, block or delete cookies and other tracking technologies is available in the settings of your browser. Please note that blocking or removing tracking technologies may affect your user experience, and certain features of the services may not function properly, or may function only partially, without these technologies.
- Personal Data Collected Across Devices. We may collect information across your devices, including mobile device, which may contain personal data, such as your device’s operating system, browser type, and the Internet Protocol (IP) address used by your device to access the internet.
You may control the permissions you grant us at any time through the settings of your device’s operating system.
- Analytics and Marketing Tools. We use tools provided by third-party vendors to analyze personal data generated through your use of the services. These tools monitor activity on the website and the use of the services and provide us with insights regarding user behavior, such as the number of users who visited the website during a given period, the most frequently viewed pages, and the actions performed by users on the website.
You may prevent the collection of personal data about you by installing a browser add-on, such as the Google Analytics Opt-Out Browser Add-On. In addition, you may prevent or limit the collection of personal data through these tools by adjusting your browser and device operation system settings.
2. Personal Data Regarding Children
The services are not directed to children, and we do not collect personal data relating to children except as permitted by applicable law.
3. What Do We Do with Personal Data Related to You?
We process personal data relating to you for the following purposes:
- To operate and enable our services, and to improve your experience with them.
- To reply to messages that you send us and correspond with you.
- To protect your rights and those of other people using our services, as well as Gain’s business, commercial and operational interests, and the interests of our service providers and related parties, and to prevent or mitigate harm or costs of any kind. For example, to detect unauthorized use, misuse, fraud, or misappropriation in connection with the services.
- To manage legal, administrative, and regulatory proceedings, including any proceedings before a competent authority.
- To comply with applicable law, as well as requirements and requests from regulatory and enforcement authorities, investigative bodies, and other competent authorities, in Israel and internationally.
4. What are My Choices Regarding the Processing of Personal Data?
You have several options to set your preferences regarding the use of your personal data. At any time, you may request that:
- At any time, you can stop using any of our services, and as a result we will stop collecting any respective personal data from you or about you through the service you stopped using. However, we will store and continue using or making available certain personal data that is relating to you. For further information, please read the section “How Long Will We Retain Personal Data” of this notice.
- Additionally, many choices are configured within the services, and you may also use your browser settings and the settings of your device’s operating system to tailor the processing of your personal data to your preferences.
5. What are My Rights and How do I Exercise Them?
- Request access to personal data about you maintained in Gain’s databases. You may also request the correction or deletion of personal data about you that is inaccurate, incomplete, unclear or outdated, subject to and in accordance with applicable law. Upon receipt of appropriate identifying information from you, we will make reasonable efforts to locate the personal data and provide it to you.
- If personal data about you has been transferred to us from the European Economic Area (EEA) by a party other than you, you have the right to request that we delete such personal data that we hold about you, subject to the limitations set out under applicable law.

7. Where is the Personal Data Stored?
The personal data we collect is stored and processed in our databases, which are maintained on Gain’s systems, as well as by hosting, server and backup service providers, which may be located outside of Israel.
We retain personal data in accordance with industry-standard security measures designed to protect such personal data and in compliance with applicable regulatory requirements.
In addition, as described in the section “Who Do We Share Personal Data With?,” certain personal data may be retained by third parties with whom we share personal data. These entities may also store such personal data outside of Israel.
Please note that the privacy protection principles and the authority of governmental entities to access personal data may differ from those in Israel.
By consenting to the personal data processing practices described in this notice, you also consent to the transfer and storage of your personal data outside of Israel.
8. How Long Will We Retain Personal Data?
We retain your personal data for as long as necessary to achieve the purposes of processing described in this notice. For example, we retain personal data as needed to provide the services and to comply with applicable law.
9. Changes to This Privacy Notice
We may update this notice from time to time, including as a result of changes in applicable law, regulatory requirements or guidance, changes in the nature or scope of the services provided by Gain, or technological developments.
We will provide advance notice of any material changes to this notice and their effective date. We may notify you of such changes through our digital channels.
Your continued use of the services following the publication of an updated notice constitutes your acceptance of the updated terms, including any changes to the ways we process your personal data.

10. How Will Organizational or Corporate Structure Changes Affect the Processing of Personal Data?
Any changes in Gain’s corporate structure will not affect our commitments under this notice.
In the event that we merge our operations with another organization, undergo any other corporate restructuring, or transfer our activities to another entity or third-party, the entity assuming our role will process your personal data in accordance with this notice.

We implement appropriate measures to protect your personal data in accordance with applicable law.
We maintain various systems, applications, and procedures designed to safeguard personal data relating to you and to minimize the risks of theft, damage, loss, or unauthorized access or use. These measures are intended to reduce security risks.
However, while we take significant steps to protect your privacy and invest considerable resources in cybersecurity and information security, no security measures are infallible. Accordingly, we cannot guarantee that the service will be immune from wrongful acts, malfunctions, unauthorized access, or other forms of misuse or unlawful activity.

This notice applies solely to the services of Gain.
Please note: the services may include links to or integrate with applications, websites or other businesses operated by third parties. This notice does not apply to such third-party or their activities.
In addition, Gain maintains pages on various social media platforms, which are subject to the privacy notices of those platforms. For example:
- Our activity on LinkedIn is subject to the privacy notice of LinkedIn; and,
- Our activity on Instagram is subject to the privacy notice of Meta.
We recommend that you review the privacy notices of these platforms before using them. We are not responsible for the privacy practices or content of such third-party services. Your use of these services is governed by their respective privacy notices, which may apply instead or in addition to this notice.
